1. Acceptance of Terms

These terms of use govern your use of IN8NESS (www.in8ness.com). By using the site, you agree to these terms in full and they form part of your contract with us to provide the website and related services, including any digital content we make available (our "Products").

Please don't register or use IN8NESS if you don't agree to these terms.

Please note that these Terms of Use may be amended from time to time. We'll notify you of any changes by posting new terms on the site. By continuing to use IN8NESS after changes are posted, you confirm that you accept the then-current Terms in full.

2. User Roles and Scope of Services

IN8NESS provides personality assessment services and related tools. Depending on the features you use, you may act in different roles:

Participants

Complete personality assessments for personal use or as part of an invitation-only study.

Study Coordinators

Create and administer studies and receive access to participant assessment results.

Additional terms may apply depending on the role you choose. Users who create or administer studies are subject to separate Study Coordinator Terms of Use, which are incorporated by reference.

3. License to Use

We may provide you with certain information as a result of your use of IN8NESS, including documentation, data, or other materials ("Company Materials"). Subject to these Terms, we grant you a non-exclusive, limited, non-transferable, and revocable license to use the Company Materials solely in connection with your use of IN8NESS and our services.

This license terminates when you stop using IN8NESS or when this Agreement ends.

4. User Accounts

When you create an account, you'll use your email address as your user identifier, along with a password. You may also provide additional personal information.

You're responsible for:

• Maintaining the accuracy of your account information
• Keeping your account credentials confidential and secure
• Notifying us promptly of any unauthorized access or changes

5. Personality Assessment Services

IN8NESS offers a variety of free and purchasable online personality tests ("Personality Assessments"). When you submit your responses, we analyze them and generate results, including numerical scores for personality traits (such as Openness, Conscientiousness, Extraversion, Agreeableness, and Neuroticism).

Study-Based Assessments

Some assessments may be completed as part of an invitation-only study created by another user (a "Study Coordinator"). In such cases:

• Your individual assessment results, including raw scores, will be shared with the Study Coordinator as disclosed to you before you participate
• Depending on how the study is configured, your username and email address may be visible to the Study Coordinator
• We don't control, supervise, or endorse how Study Coordinators use assessment results

6. Studies and Third-Party Data Sharing

Studies on IN8NESS are invitation-only and participation is voluntary. Before you participate in a study, you'll be informed of the Study Coordinator's identity and contact information, as well as the nature of the data that will be shared.

We are not a research institution and do not review or approve study design, purpose, or use.

7. Acceptable Use

You agree not to use IN8NESS for any unlawful purpose or any purpose prohibited under this Agreement, including but not limited to:

• Harassment, abuse, or violation of others' legal rights
• Fraud or misrepresentation
• Unlawful data collection or re-identification of anonymous participants
• Use of assessment results for clinical diagnosis, medical or mental health treatment, employment or hiring decisions, insurance, credit, or other regulated determinations
• Discriminatory or unlawful profiling

Any misuse of IN8NESS may result in suspension or termination of your access.

8. Assumption of Risk

IN8NESS is provided for informational and communication purposes only. No fiduciary, professional, or advisory relationship is created. Your use of IN8NESS and purchase of Products are at your own risk.

9. Refunds Policy

If you're not satisfied with any digital content purchased from IN8NESS, you may request a refund within 30 days of purchase by contacting support with your order information.

10. Data Loss

We do not accept responsibility for the security of your account or content, including exported study data. Your use of IN8NESS is at your own risk.

11. No Warranties

IN8NESS is provided "as is" and "as available," without warranties of any kind. We do not warrant the accuracy, availability, or suitability of assessments or results for any particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of IN8NESS, including emotional distress or data loss.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your use or misuse of IN8NESS, including study-related activities.

14. Violations of These Terms

We may suspend or terminate your access for violations of these Terms.

15. Severability

If any provision of these Terms is held invalid, the remaining provisions shall remain in effect.

16. Modification & Variation

We may modify these Terms at any time by posting updated Terms on IN8NESS. Continued use constitutes acceptance.

17. Assignment

We may assign our rights and obligations under these Terms without notice. You may not assign your rights without our prior written consent.

18. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of IN8NESS.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Minnesota, and you submit to the non-exclusive jurisdiction of courts located in Minnesota.
